Abstract
Artificial intelligence is one of the emerging technologies that has played a significant role in various fields in recent years. However, this technology is accompanied by numerous legal and political challenges and has unknown dimensions that can cause harm and damage to consumers and third parties. The present study uses a descriptive-analytical method to answer the fundamental question: "To what extent is the scope of producer liability in American law and under what conditions is the producer exempted from liability?" The research hypothesis emphasizes that in the American legal system, producer liability is not based on the assumption of fault, but is largely based on absolute liability. This approach is designed to provide maximum consumer protection and requires manufacturers to comply with safety standards at all stages of design, production, and distribution. The findings show that the scope of this liability in US law is broad, and manufacturers can only be exempted from liability if they can prove that they have complied with all safety principles and that the benefits of the AI-based product outweigh its disadvantages. American legal practice, especially in cases related to new technologies, uses various principles and doctrines to determine the limits of manufacturers' liability. These principles not only help clarify the scope of liability, but also provide consumers with greater protection against possible harm. The results of the study showed that the diversity and breadth of damages that can be claimed from manufacturers in American law indicate the high flexibility of this legal system in terms of compensating for losses. As a result, it can be said that American law, by adopting a protective and developed approach, tries to prevent the violation of consumer rights against artificial intelligence products while encouraging innovation.
